Terms of Use

1. Agreement to Terms

By accessing and using Zameel ("Platform", "Service", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily access the Platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display (commercial or non-commercial)
• Attempt to decompile or reverse engineer any software contained on the Platform
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Zameel at any time.

3. Account Registration

To use certain features of the Platform, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify us if you discover or suspect any security breach related to the Platform
• Take responsibility for all activities that occur under your account

4. Store Owner Responsibilities

If you register as a store owner, you additionally agree to:

• Provide accurate product descriptions, pricing, and availability information
• Fulfill orders in a timely manner and provide appropriate customer service
• Comply with all applicable laws and regulations regarding e-commerce and consumer protection
• Not sell prohibited, illegal, or counterfeit items
• Honor refund and return policies as stated
• Maintain appropriate business licenses and permits
• Pay all applicable fees including subscription fees and platform commissions

5. Customer Responsibilities

If you use the Platform as a customer, you agree to:

• Provide accurate delivery and payment information
• Use the Platform only for lawful purchases
• Not engage in fraudulent transactions or payment disputes without valid cause
• Respect store owners' policies regarding returns, refunds, and exchanges
• Not abuse or misuse the loyalty rewards or promotional systems

6. Payments and Fees

For Store Owners:

• Subscription fees are charged based on the plan you select
• Platform commission fees may apply to transactions
• Fees are non-refundable except as required by law
• We reserve the right to change fees with 30 days notice
• Payouts are processed according to the schedule outlined in your account settings

For Customers:

• Payment is due at the time of purchase
• We use Stripe for secure payment processing
• Refunds are subject to the store's refund policy

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by Zameel and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not duplicate, copy, or reuse any portion of the HTML/CSS, JavaScript, or visual design elements without express written permission.

Store owners retain ownership of the content they upload (product images, descriptions, etc.) but grant us a license to display and distribute this content through the Platform.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating laws and regulations
• Infringing on intellectual property rights
• Transmitting viruses, malware, or other malicious code
• Attempting to gain unauthorized access to the Platform or other accounts
• Engaging in any automated use of the system
• Interfering with or disrupting the Platform or servers
• Impersonating another person or entity
• Selling or transferring your account
• Harassment, abuse, or harm of other users
• Collection of information about users without consent

9. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request account deletion.

10. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Zameel makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

11. Limitation of Liability

In no event shall Zameel, nor any of its officers, directors, and employees, be liable for anything arising out of or in any way connected with your use of this Platform, whether such liability is under contract, tort or otherwise. Zameel shall not be liable for any indirect, consequential, or special liability arising out of or in any way related to your use of the Platform.

12. Indemnification

You agree to indemnify, defend, and hold harmless Zameel and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Platform will be resolved through binding arbitration, except that either party may seek injunctive relief in court for the purpose of enforcing this agreement or preventing violations. The arbitration will be conducted in accordance with the rules of the applicable arbitration association.

14. Returns and Refunds

Returns and refunds are handled by individual store owners according to their policies. Zameel facilitates these transactions but is not responsible for refund disputes. We encourage customers to review store policies before making purchases.

15. Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, the Platform (or any part thereof) with or without notice. You agree that Zameel shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Platform.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Zameel operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

By using the Platform, you acknowledge that you have read these Terms of Use and agree to be bound by them.
